 Post subject: Shipping to a Smith?

Just a general question.....

Can I ship a complete rifle or pistol to a gunsmith out of state for workor refinishing even if said gunsmith does not have an FFL?

I'm sure this has been answered a hudred times-sorry for any duplicate.

Another thing to think about is the fact that if this 'gunsmith' doesn't have an FFL, I would question his or her skill level.

Also, I believe by federal law a "gunsmith" must have a FFL. By that, I mean my interpretation of the law is that to work on someone else's firearm a FFL is required, even if the "gunsmith" is not taking posession of the gun.

McNabb, not that having the FFL means any particular level of skill is possessed by the holder (not like there's a skills test to get it). And, it's not like those of us who have them look down upon anyone who tweaks a gun without having it. Just that, indeed, a person is supposed to have it to engage in the business... I mean, I suppose if you bring your gun into your cousin's tire shop to let him blow it out with compressed air, on some silly level there is a law being broken. On the other hand, it you were to ship the whole gun minus the receiver to a machine shop on the other end ofthe country, I don't believe there's any problem there since the serialized part is not being transferred..... but I could be wrong about that, and it is often hard to find the one, true answer to these questions in print...... and the say-so of a BATFE agent is not necessarily the last word that one should bet the next ten years on.

My biggest concern here would be for the guy who may be working on guns without a license. I don't give a rip about him breaking a law, I'm just worried about him getting in trouble.

BATF requires that if a gunsmith takes possession of another's firearm and can not complete the work in the same business day he is then required to log it into his bound book,

So if you can't do the work in the same day you indeed need a 07 FFL.
